How to Use Revocable Living Trusts to Avoid Probate

In this article, our McHenry County estate planning attorneys explain how we use revocable living trusts to avoid probate as part of a good estate plan. If you pass away owning any real estate outside of a trust or more than $100,000.00 outside of a trust or payable on death accounts, a probate case will likely be required in order for your loved ones to receive your assets.

We want to avoid probate, because the case takes at least a year, during which time your loved ones will not have access to your assets. Your estate will also have to pay attorney fees and court costs, which can consume a significant amount of your estate.
