This new case adds to five other lawsuits previously filed in Sangamon County. 

    Details of the Legal Actions 

    The legal actions against Heinz Funeral Home are multifaceted, involving nearly three dozen counts. The charges include negligence, violation of state law, intentional infliction of emotional distress, and interference with the right to possession. These allegations reflect the severe breach of trust that families have experienced. 

    Albert A. Heinz, the owner of the funeral home, and Jon Clayton Heinz, along with Family Care Cremations, are named as defendants in multiple lawsuits.

    The lawsuits seek damages exceeding $50,000 for many of the counts, aiming to address the significant emotional and financial toll on the families. 

    Case Highlights and Personal Stories 

    One example is the case of Gina Bricker. On September 17, 2023, her children were given a decorative urn by Albert Heinz, supposedly containing her remains. However, just eight days later, a conference call with Coroner Jim Allmon and a local hospital revealed that Gina Bricker’s body was still in the morgue in an advanced state of decomposition. If accurate, this certainly would be distressing.  

    Another distressing aspect of the case involves four families who discovered that the wrong cremains had been placed at the Camp Butler National Cemetery, a resting place for U.S. veterans.  

    Legal and Emotional Implications 

    The lawsuits collectively represent the families of 14 deceased individuals, a fraction of the nearly 80 affected. This suggests that many more families may still be grappling with the fallout of this situation.

    Currently, six out of the 14 individuals mentioned in the lawsuits have not had their ashes returned to their families, adding to the ongoing distress. 

    The legal implications for Heinz Funeral Home are severe. The counts of negligence and violation of state law, if proven, could result in substantial financial penalties and further legal repercussions. The intentional infliction of emotional distress charges highlights the deep emotional trauma experienced by the families, a factor that juries could take seriously. 

    Ongoing Investigations and Future Prospects 

    Macoupin County State’s Attorney Jordan Garrison has indicated that the Illinois State Police’s criminal investigation is ongoing. This means that while civil lawsuits are in progress, there may also be criminal charges forthcoming, depending on the findings of the investigation. 

    Coroner Jim Allmon expressed uncertainty about when the issue might be resolved, reflecting the complex and evolving nature of the case. The inability to reach Albert Heinz for comment further complicates the situation, leaving many questions unanswered. 

    Conclusion 

    While, if true, these allegations are severe and describe appalling conduct, it is important to remember that civil lawsuits are ongoing processes of truth-finding. If this case is put forward to a jury, the peers of the owners and the family of the deceased will decide the proper way forward.
