The Peoria Surgery Case Ruling and A Closer Look at the Verdict

September 5, 2024

A Peoria jury awarded over $2M for negligence by a pediatric surgeon in a 2010 case involving a botched esophagus procedure on a young girl, causing severe complications.

Key Takeaways

  • In a case dating back to 2010, a Peoria County jury found a pediatric surgeon negligent, awarding over $2 million in damages for complications arising from a botched procedure on a young girl.
  • The surgeon's error, involving a two-centimeter tear in the girl's esophagus and a misplaced stent, resulted in severe complications, including long-term feeding difficulties requiring a feeding tube.
  • The lengthy legal process, typical in medical malpractice cases, involved extensive investigations, negotiations, discovery, and alternative dispute resolution efforts before reaching a jury verdict.

In a recent ruling that garnered significant attention, a jury in Peoria County reached a verdict regarding a surgery case that dates back to 2010. The case involved allegations of negligence against a pediatric surgeon stemming from his treatment of a young girl who visited the hospital due to a choking episode.

Allegations of Negligence

The incident occurred in July 2010 when the girl, then only nine months old, was brought to OSF Children's Hospital in Peoria after experiencing a choking episode. During the visit, the doctor examined the girl's esophagus and discovered a piece of carrot along with a narrowed area known as a stricture. While attempting to dilate the stricture, the surgeon inadvertently caused a two-centimeter tear in her esophagus. In an attempt to address the tear, he used an adult airway stent, which he accidentally dropped into her stomach, where it remained for 11 months. This led to significant complications for the young girl, including feeding difficulties that necessitated the use of a feeding tube inserted through her abdomen into her stomach.

The Lengthy Legal Process

One question that arises in cases like this is why it took so long for a resolution to be reached. Legal proceedings, especially those involving medical malpractice, can often be protracted affairs. Several factors may contribute to the extended timeline:

  1. Investigation and Preparation: Legal teams on both sides must conduct thorough investigations, gather evidence, and meticulously prepare their cases. This process can be time-consuming, particularly in complex medical cases involving extensive medical records and expert testimony.
  2. Negotiation and Settlement Attempts: Before resorting to a trial, parties often engage in negotiation and settlement discussions. These negotiations can take months as both sides attempt to reach a mutually acceptable resolution.
  3. Filing and Preliminary Motions: Once a lawsuit is filed, the court may need to address various preliminary motions and responses, which can further prolong the process before the case progresses to trial.
  4. Discovery and Depositions: Discovery, the phase where both parties exchange information and evidence, can also contribute to delays. Depositions, in particular, involve scheduling witnesses and attorneys and transcribing testimony and can take several weeks or even months to complete.
  5. Alternative Dispute Resolution (ADR): Many courts encourage or require parties to attempt alternative dispute resolution methods such as mediation or arbitration before proceeding to trial. While ADR can lead to quicker resolutions, it still adds time to the overall process.

The Verdict

After years of legal proceedings, the jury ultimately found the surgeon negligent in his treatment of the young girl. The verdict awarded the girl more than $2 million in damages for the injuries she sustained as a result of the surgical procedures performed.

While the verdict represents a significant outcome for the plaintiff and her family, it also underscores the complexities and challenges inherent in many legal cases. The legal process, though lengthy, serves as a mechanism for seeking accountability and compensation for individuals who have suffered harm due to alleged negligence.

The recent ruling in the Peoria surgery case highlights the importance of thorough investigation, diligent preparation, and perseverance required in navigating the legal system. It reminds us of the complexities involved in medical malpractice cases and the need for a balanced approach to seeking resolution and accountability.
