In Wisconsin, hemp products like Delta-8 THC thrive despite marijuana's illegality, sparking debates on safety, regulations, and future policies.
In Wisconsin, the landscape of marijuana alternatives is a complex and evolving field, often described as a regulatory "gray zone." Despite marijuana's illegal status in the state, products derived from hemp, like Delta-8 THC, have surged in popularity and economic significance. These products present a unique challenge to both consumers and legislators as they navigate the murky waters of legality and regulation.
The 2018 Farm Bill marked a significant turning point by legalizing the production of hemp, defined as cannabis containing no more than 0.3 percent Delta-9 THC. This legislative change opened the floodgates for hemp-derived products, including Delta-8 THC, which is known for its milder intoxicating effects compared to Delta-9 THC. During a recent interview with "Wisconsin Today," Professor Lucas Richert from the University of Wisconsin-Madison recently described the difficulty in understanding the legal status and effects of these products: "You almost need a Ph.D. in agriculture and maybe also a law degree to understand what's happening here." 1
The current state of hemp-derived products in Wisconsin is a patchwork of self-imposed regulations and consumer vigilance. Knuckleheads Wellness in Madison, for example, has set its age limits for purchasing Delta-8 THC products. Assistant Manager Fit Getahun recently highlighted the need for more explicit regulations to ensure consumer safety and industry standards: "We realize that we need to start stringently regulating who can or can't purchase these items." 2
Following the legalization of hemp, Delta-8 THC products have rapidly grown across Wisconsin. These products, which include oils, tinctures, soft gels, edibles, topicals, and vape products, are marketed as "legal cannabis" due to their hemp-derived status.
However, the safety and potency of these products remain largely unregulated, leaving consumers to navigate a "Wild West" of options. Richert has emphasized the need for consumers to conduct thorough research, from checking company certifications to seeking advice on forums like Reddit.3
The widespread growth of Delta-8 THC products in Wisconsin has not gone unnoticed by state legislators. Earlier this year, a proposed bill to legalize medical marijuana in the state failed to pass despite its strict regulations on eligibility and distribution. Meanwhile, some legislators have proposed banning Delta-8 and similar products, citing safety concerns.
State Sen. Melissa Agard and other Democratic lawmakers advocate for the legalization and regulation of both marijuana and hemp products, arguing that a more structured approach would benefit consumers and the state economy.4
As the debate over Delta-8 and other cannabis products continues, the future of cannabis policy in Wisconsin remains uncertain. A proposed amendment to the 2024 Farm Bill aims to restrict hemp to non-intoxicating uses, potentially dismantling the burgeoning market for products like Delta-8. Meanwhile, state-level discussions on medical and personal-use cannabis programs continue to unfold.5
The emergence of Delta-8 THC and similar hemp-derived products has significantly impacted the marijuana debate in Wisconsin. As legislators, consumers, and industry stakeholders navigate this complex landscape, the need for clear, comprehensive regulations becomes increasingly apparent. The ongoing discussions and legislative efforts will shape the future of cannabis policy in Wisconsin, aiming to balance innovation, safety, and economic benefits.
