To start the real estate transaction many steps must be taken, the first is for you realtor to prepare a contract for the sale or purchase. They will next send it to the receiving party once the contract is completed by both parties will send the agreed upon contract to their attorneys for further review.
Our Lake in the Hills attorneys will sit down with you and go over your contract thoroughly to ensure that you know what is it you are agreeing too. If notifications need to be made, we will send out a letter to the other parties’ attorney with proposed modifications. Also, we may request that the time of modification be extended until both sides have come to an agreement on the modifications.
Once all the home inspections have been completed, if you are the buyer, our attorneys will review the report with you. We will then advise you as to how to deal with any findings the inspector may have come across. A letter will be sent to the seller’s attorney asking that said problems be fixed prior to closing with receipts provided. If this is not a solution you both agree on we can ask that cash or credits be provided at closing to make up for the cost of your own repairs.
When an agreement is made on modifications that need to be addressed, an addendum to the contract listing all modifications will be drafted. We will then provide you with a copy of the addendum to your lender and realtor. Between then closing the seller’s attorney will get all necessary documents prepare and obtain title insurance to ensure that the selling party has the complete title to the property being sold. This is done while the buyer’s attorney works with the lender to make sure that the transaction will go off without a hitch and on time.
Finally, at the time of closing the seller’s attorney will deliver the title company along with the closing documents. The buyer’s attorney will then go over closing figures to ensure everything is correct and explain the closing and loan documents, in detail to the buyer. They will work to fix any issues with the prepared documents that prevent closing.
